1. Acceptance of Terms
By accessing or using Lobster.cash (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Lobster.cash, operated by Crossmint ("Company," "we," "us," or "our").
By using the Service, you represent that you are at least 18 years of age, have the legal capacity to enter into contracts, and are not prohibited from using the Service under applicable law.

2. Description of Service
Lobster.cash is a payment infrastructure platform designed to enable AI agents to make purchases and payments on behalf of their users. The Service provides:
- Issuance of virtual payment cards powered by Visa's VIC technology, allowing AI agents to make purchases at any merchant that accepts credit cards.
- Stablecoin payment capabilities using USDC on the Solana blockchain, enabling crypto-based transactions including x402 protocol endpoints.
- A user-controlled approval system allowing you to authorize, limit, and audit payments made by your AI agent.
- Integration tools, APIs, and SDKs for connecting AI agents such as Claude Code, Cursor, Anthropic, Codex, Gemini, and others.
- A dashboard for reviewing transaction history and managing agent access to funds.
The Service is powered by infrastructure from Crossmint, Visa, Stytch, Circle, Basis Theory, and Solana.

3. Account Registration and Security
3.1 Account Creation
To use the Service, you must create an account using supported authentication methods (including Google OAuth or other options provided by Stytch). You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Notify us immediately of any unauthorized access to or use of your account.
- Not share your account credentials with any unauthorized third party.
- Take reasonable steps to prevent unauthorized access to your account.
We are not liable for any loss or damage arising from your failure to maintain the security of your account.
3.3 Agent Access
When you grant an AI agent access to your Lobster.cash wallet or virtual cards, you are solely responsible for the permissions and spending limits you configure. You acknowledge that any transaction authorized by your agent within the limits you set constitutes an action taken on your behalf.

4. Payment and Financial Terms
4.1 Virtual Card Issuance
Virtual cards issued through Lobster.cash are subject to the terms and conditions of our card-issuing partners, including Visa. Each virtual card may be subject to spending limits, expiration dates, and usage restrictions that you configure.
4.2 Stablecoin Transactions
Stablecoin transactions are processed on the Solana blockchain using USDC. You acknowledge and accept that:
- Blockchain transactions are irreversible once confirmed.
- Transaction fees ("gas fees") may apply and are subject to network conditions.
- The value of USDC is pegged to the US Dollar, but this peg may not always hold.
- Blockchain network outages or congestion may affect transaction speed and availability.
4.3 Non-Custodial Wallets
Stablecoin wallets provided through the Service are non-custodial. This means:
- You retain sole control of your private keys and are solely responsible for the security of your wallet.
- Lobster.cash does not hold, store, or have access to your private keys or wallet funds.
- We cannot recover your wallet, reverse transactions, or restore access if you lose your credentials.
- You bear full responsibility for any loss of funds resulting from lost keys, unauthorized access, or user error.

5. Agent Payments and User Responsibility
You expressly acknowledge and agree that:
- You are fully responsible for any payments made by an AI agent you have authorized through the Service, within the limits and permissions you have configured.
- Lobster.cash provides a mechanism for you to control and audit agent spending; however, we do not monitor or control the instructions given to your AI agent.
- It is your responsibility to configure appropriate spending limits and review transaction logs regularly.
- We are not responsible for any purchases, commitments, or liabilities incurred by your AI agent, even if they are unintended.
- The Service is not a guarantee against fraud or misuse by AI agents; you should implement appropriate safeguards on your AI agent's capabilities.

6. Third-Party Services and Integrations
The Service integrates with third-party platforms, including but not limited to AI agent frameworks (Claude Code, Cursor, Gemini, Codex), payment networks (Visa), authentication providers (Stytch), stablecoin issuers (Circle), and blockchain networks (Solana).
We are not responsible for the availability, accuracy, or terms of any third-party services. Your use of third-party services is subject to their respective terms and conditions. We disclaim all liability for any actions taken by third-party services in connection with your use of the Service.

7. Disclaimers and Limitation of Liability
7.1 Service Provided "As Is"
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
7.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOBSTER.CASH AND CROSSMINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
7.3 Non-Custodial Wallet Risk
Because wallets are non-custodial, Lobster.cash has no ability to recover lost funds, reverse transactions, or restore access to wallets. You assume sole and full responsibility for the security and management of your wallet credentials and any resulting loss of funds.
7.4 Blockchain and Financial Risks
You acknowledge the inherent risks associated with blockchain technology and digital assets, including but not limited to price volatility, regulatory uncertainty, smart contract vulnerabilities, and the irreversibility of blockchain transactions. You assume all such risks.

8. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, by sending you a notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
